DMCA & Intellectual Property Enforcement Policy

This DMCA & Intellectual Property Enforcement Policy (“Enforcement Policy”) sets out the procedures used by Ineedthat to protect its intellectual property and to respond decisively to unauthorised use, infringement, misappropriation, or exploitation of its content.
This Policy applies globally and operates in conjunction with the Privacy & Intellectual Property Protection Policy and Terms of Service of www.ineedthatnow.org.


1. Rights Holder Identification

Sole Rights Holder: Simon Mischa van der Schaar
All intellectual property rights vest exclusively in Simon Mischa van der Schaar.


1.1 Succession of Rights
In the event of death or incapacity, all intellectual property rights automatically transfer to Malakai Kipchumba van der Schaar, without limitation.

2. Protected Content
This Enforcement Policy covers, without limitation:

  • All artworks, illustrations, and visual designs

  • AI‑assisted artworks and human‑curated outputs

  • Wall art, apparel, phone case, and jigsaw puzzle designs

  • Product mock‑ups, previews, and renders

  • AI advertising videos, motion graphics, and individual frames

  • Website layout, structure, and UI/UX design

  • Marketing materials, copywriting, and brand assets

  • Prompts, workflows, datasets, and internal systems

Protection applies whether content is watermarked, unwatermarked, resized, cropped, altered, recoloured, animated, or partially reproduced.

3. Infringing Conduct
The following activities constitute infringement and will be acted upon:

  • Copying or reproducing designs or images

  • Uploading content to third‑party marketplaces or POD services

  • Using content in advertisements, social media, or videos

  • Extracting still frames from videos

  • Training or referencing AI models using our content

  • Creating derivative works based on our designs

  • Claiming inspiration, transformation, or parody for commercial use

  • Scraping, harvesting, or automated extraction of content

Any attempt to disguise infringement is treated as wilful infringement.

4. DMCA & International Takedown Notices
Where infringement is identified, Ineedthat may issue:

  • DMCA takedown notices (United States)

  • Copyright infringement notices (Australia)

  • Platform‑specific intellectual property claims

  • Hosting provider abuse reports

  • Payment processor infringement notices

Notices may be issued without prior warning.

5. Counter‑Notice Policy
If a counter‑notice is received, Ineedthat reserves the right to:

  • Reject invalid or incomplete counter‑notices

  • Require sworn statements or additional evidence

  • Escalate the matter to legal proceedings

Submission of a false counter‑notice may result in liability for damages.

6. Repeat Infringer Policy
Any individual or entity found to infringe multiple times will be designated a Repeat Infringer.
We may:

  • Request permanent account termination

  • Notify platforms and marketplaces

  • Escalate enforcement actions

  • Seek injunctive relief and damages
     

7. Evidence Collection & Monitoring
We actively monitor infringement using:

  • Digital fingerprinting and metadata analysis

  • Reverse image and video search tools

  • Marketplace and social platform surveillance

  • Forensic similarity analysis

Evidence is retained for enforcement and legal proceedings.

8. Jurisdiction & Enforcement

This Policy is governed by the laws of Australia.

I NEED THAT reserves the right to enforce its intellectual property rights in any jurisdiction worldwide where infringement, misuse, copying or unauthorised distribution occurs. This includes the right to pursue legal action, takedown requests and enforcement measures across international platforms, marketplaces and legal systems where applicable.



9. No Waiver
Failure to act on any infringement does not constitute a waiver of rights.
